Legal Consideration of Psychotherapy Discussion

Psychopharmacology is mainly what PMHNP practices. We focus on prescribing medication and adjusting that medication to influence the neurons and chemical receptors in the brain. This lesson has demonstrated the power of psychotherapy. Psychotherapy can help the pathways of the brain develop as we learn. Legal Consideration of Psychotherapy Discussion  According to Malhotra & Sahoo (2017) Brain development, though under the influence of genetic programming through centuries of evolution, occurs as a result of environmental influences comprising interpersonal and social experiences and learning  Everyone tends to learn at a different pace or speed which is because certain areas of the brain are responsible for development.

When we try to develop all of those areas long term, we can see progress. The brain can learn and reprogram itself after any age or circumstance. Effort must be made by the client to understand and learn new information to help them with their behaviors and actions. The patient must participate daily in activities that help the brain grow to see changes. Psychotherapy and neuronal pathways with psychopharmacology share the same pathways in the brain by evidence found in research. According to Schwartz & Santarsieri (2016) Since ADT was not prescribed, it must be hypothesized that psychotherapy promoted corrective neurofunctional changes. Medication and psychotherapy both deem to be beneficial in reforming the connectivity in the brain. According to Malhotra & Sahoo (2017) Fundamental principles and conditions created during the psychotherapy process cause the brain to change its structure and functions.

Influences on our behaviors and ideas can be from culture, religion, or socioeconomic status. As providers we try to influence patients to make more positive decisions, but outside influences can also have negative effects on the brain. Being culturally competent can help our clients to achieve the best outcome. Educating patients on socioeconomic status and continuing with psychotherapy to reprogram the negative mindset from disgrace, shame, or entitled to better behaviors can be achieved.

Legal and ethical considerations for group, family and individual therapy are informed consent, responsibility, and confidentiality. All of these issues have to be understood by the group or family. When providing care for individuals there are no issues with information being leaked by outside sources in regulations with HIPPA. While completing family treatments all those in the group are usually there to focus on their relationships and communication with each other. Family therapy is a structured form of psychotherapy that seeks to reduce distress and conflict by improving the systems of interactions between family members (Varghese et al, 2020). Patients will need to sign confidentiality agreements prior to their sessions.

When obtaining information from an individual’s appointment we can not take that information into the family session, since that is breaking confidentiality for that individual person. PMHNP may lead the discussion and help to make positive influences to produce change but not by divulging a certain family member’s information. Therapeutic approaches would differ by making sure the proper etiquette for family and group sessions are properly explained and that every person going into the group signs a confidentiality agreement prior to the session. The agreement prior is what can protect the PMHNP legally if ever in court to report what ensued during an appointment.
